Abstract English

This study compared the judicial seizure of public funds in Omani and Egyptian legislation. To illustrate, it examined the permissibility of preventing the judicial seizure law of all funds owned by the state, regardless of whether allocated for public benefit or privately owned by the state. This study concluded that the Omani legislator applied the non-seizure law to all state-owned funds, regardless of whether they were allocated for public benefit. On the other hand, the Egyptian legislature limited the application of this law to funds owned by the state publicly and did not include other funds. Therefore, the study recommended that the Omani legislature should restrict the application of the non-seizure law to publicly owned funds; without including privately owned state funds. That is because of its inconsistency with the legal system governing the last funds, which allows their judicial seizure.

الملخص العربي

تناولت هذه الدراسة موضوع الحجز القضائي على الأموال العامة في دراسة مقارنة بين التشريع العماني والتشريع المصري، وهدفت الدراسة إلى استعراض الأحكام القانونية التي قررها كلا المشرعين في الحجز القضائي على الأموال العامة، وقد اتبعت الدراسة المنهج التحليلي والمنهج المقارن، كما تطرقت الدراسة إلى مشكلة أساسية تتمثل في مدى جواز انطباق قاعدة عدم جواز الحجز القضائي على كافة الأموال المملوكة للدولة سواء المخصصة للمنفعة العامة أو المملوكة للدولة ملكية خاصة. وقد خلصت هذه الدراسة إلى أن المشرع العماني شمل في تطبيق قاعدة منع الحجز القضائي كافة الأموال المملوكة للدولة بغض النظر ما إذا كانت مخصصة للمنفعة العامة من عدمه، في حين اقتصر المشرع المصري في تطبيق حكم هذه القاعدة على الأموال المملوكة للدولة ملكية عامة دون غيرها من الأموال، وبذلك أوصت الدراسة المشرع العماني بضرورة الاقتصار في تطبيق قاعدة عدم جواز الحجز القضائي على الأموال المملوكة للدولة ملكية عامة دون أن يشمل ذلك الأموال المملوكة للدولة ملكية خاصة.
