Abstract English

This study aims to highlight the necessity of developing judicial papers to align with the use of multiple Artificial Intelligence Systems (AIS). It explores the role of AIS in enhancing the structure and delivery of judicial papers intended for the opponent’s awareness, focusing on the procedural requirements outlined in the Kuwaiti and Omani civil and commercial procedure codes. The research adopts a descriptive and analytical approach, examining the legal frameworks and solutions that facilitate the effective integration of AIS in the development and delivery of judicial papers.The study envisions the utilization of AIS to design virtual assistants capable of interpreting the provisions within the Kuwaiti and Omani procedural codes regarding judicial announcements. These systems would simulate human cognition to manage notifications, streamline communication processes, and uphold the principle of adversarial confrontation between parties. A customized data bot could be employed to design judicial papers, enabling communication via voice and video, ensuring the recipient’s awareness of hearing schedules, or submission of defense memoranda. Additionally, the study proposes leveraging features of smartphone applications like REPLIKA to expand the range of electronically submitted pleadings and facilitate the delivery of notifications, warnings, and order attend through AIS. The research concludes by emphasizing the importance of utilizing patented algorithms to enhance judicial papers through AIS processing, ensuring improved functionality and compliance with procedural regulations.

يهدف ه ذا البحث للوصول إلى نتائج تتعلََّق بضرورة تطويرالورقة القضائيََّة بما يتناسب واستخدام الأنظمة المتعدِِّدة للذََّكاء الاصطناعي، فيضوء الأوراقالقضائيََّةالتي يرادعِِلمالخصمِِبها،ومتطلََّبات الاستفادة من أنظمة AIS في تغ ر يّر وتطوّّر شكل الورقة القضائيََّة المعلنة، بما يمكّّن سهولة تسليمها للخصم المعلن إليه،وفق أحكام قانون المرافعات،)الإجراءات(المدنية والتّّجارية الكوََيتي والعُُماني. واعتمد على المنهج الوصفي التّّحليلي، ومناقشة الحلول القانونية التي تتيح فاعليّّة استخدام أنظمة AIS ، في تطوير الورقة القضائية المعلنة. وتوصل البحث إلى أناستخدام أنظمةال ذكاء الاصطناعيفي إنشاء مساعد افتراضي،يستوعب الأحكام الواردة في قانون المرافعات)الإجراءات( الكويتي والعُُماني، في خصوص إعلان الورقة القضائيََّة.محاكاةُُ العقل البشري لإدارة الإعلان )المحضر( والتّّنفي ذ، في تيس ير إجراءات التّّواصل،بما يحقِِّق مبدأ المواجهة بين الخصوم.تخصيصُُ Data Bot لتصميم وإنشاء الورقة القضائية المعلنة، بما يتيح التواصل بالصّّوت والصّّورة؛ليتحقّّق العلم اليقيني في الواقع، بحضور المراد إعلانه الجلسة أو تقديمه م كّذّرة بدفاعه. الاستفادة من مميزات تطبيق: REPLIKA على الهواتف ال ذّّكية؛ليتّّسع نطاق أوراق المرافعات)الإجراءات( التي يجوز لمحامي الخصوم تقديمها إلكترونيًًّا، وتسهيل إجراءات تسلّّم الإعلانات والإن ذارات، وتكاليف الحضور م لحامي الخصوم عبر أنظمة ال ذّّكاء الاصطناعي.
