Abstract English

This research addresses the issue of sales during death illness from a comparative perspective between Palestinian Civil Law and the Journal of justice judgements. The study aims to analyze the legal provisions concerning the validity of transactions made by a terminally ill patient and their impact on the rights of heirs. It examines the conditions necessary for the validity of sales during death illness under both legal systems and highlights the differences, particularly regarding the enforcement conditions and the approval required from heirs. The study concludes with a detailed comparison of the legal texts and analyzes the impact of these provisions on financial transactions involving a terminally ill patient. The researcher has concluded that it is essential to introduce medical criteria for assessing the patient’s condition, rather than relying on traditional definitions that may not align with modern medical advancements.

الملخص العربي

يتناول هذا البحث مسألة البيع في مرض الموت من منظور مقارن بين القانون المدني الفلسطيني ومجلّّة الأحكام العدليّّة، ويهدف البحث إلى تحليل الأحكام المتعلّّقة بصحّّة تصرّّفات المريض خلال فترة مرض الموت وتأثيرها على حقوق الورثة، يتناول البحث ال ر شّروط ال الّا زمة لصحّّة البيع في مرض الموت وفقًًا للتّّ شريعين، ويُُبرز التّّباين بينهما؛ خاصّّةًً فيما يتعلّّق بتحديد شروط النّّفاذ والإجازة من قبل الورثة، ويُُختتم البحث بمقارنة تفصيليّّة بين النّّصوص القانونية، وتحليل أثرها على المعاملات الماليّّة المرتبطة بالمريض في مرض الموت، وقد توصّّل الباحث إلى ضرورة إدخال معايير طبّّية لتقييم حالة المريض بدلاًً من الاعتماد على التّّعريفات التّّقليديّّة التي قد لا تتماشى مع التّّطوّّرات الطّّبيّّة الحديثة.
