Abstract English

The family relationship, particularly the marital bond, is among the most sacred relationships, serving as the foundation for the cohesion of strong families and communities. Accordingly, this study aims to highlight the importance of maintaining family and marital relationships within a secure and stable environment, which is a right for families, spouses, and society. It also aims to protect personal rights and public freedoms, ensuring they are worthy of criminal protection against all forms and patterns of undermining familial and marital bonds, which could potentially threaten society as a whole. The study employed a descriptive-analytical approach, focusing on describing and interpreting the legal provisions related to this crime, analyzing the relevant legal texts, and providing legal opinions regarding them. This analysis was conducted from the researcher’s modest perspective, which may contribute to raising the awareness of the Jordanian legislator about the significance of this crime. The findings of the study revealed that the crime of disrupting the marital bond is of a religious, social, and moral nature, and holds significant importance regarding both the family and society as a whole. The study concluded that the Jordanian legislator should work on revising Article (304/3) due to its legislative weaknesses and ambiguities in its current form.

الملخص العربي

هدفت هذه الدّّراسة إلى تسليط الضََّوء على أهمّّية الحفاظ على العلاقة الأسرية، والعلاقة الزََّوجية في بيئة آمنة ومستقرََّة، والتي تعد حقًًّا للأسرة والزََّوجين والمجتمع، وحماية للحقوق الشََّخصية والحريََّات العامََّة، والتي يجب أن تكون جديرة بالحماية الجزائية، لمواجهه كافََّة صور هدم الرََّابطة الأسرية والزََّوجية، والتي من الممكن أن تُُهدِِّد المجتمع ككل. استخدمت الدِِّراسة المنهج الوصفيََّ التََّحليلي القائم على وصف النّّصوص القانونية ذات الصّّلة بهذه الجريمة، والعمل على تحليل النّّصوص القانونية وإبداء الرََّأي القانوني حولها. وبيََّنت الدِِّراسة أنََّ جريمة إفساد الرََّابطة الزََّوجية، جريمة ذات طابع ديني واجتماعي وأخلاقي، ولها أهمّّية كبيرة تتعلّّق بالأسرة والمجتمع ككل. وخلُُصت إلى أنََّ على المشرع الأردني العمل على إعادة صياغة نصّّ المادََّة 304 / 3 لوجود غموض وضعف في الصِِّياغة التََّشريعيََّة من النََّاحية الشََّكلية، والعمل على رفع العقوبة إلى الحدِِّ الأعلى للعقوبة المقرََّرة في الجُُنح.
